A British Columbia-based realtor failed to convince a judge that negligence on the part of a Sun Peaks Resort lift attendant caused her to get hit by a chair. Cathy Morgan sued the mountain after dislocating her hip while getting run over by a chair, and accused a lift attendant of not hitting the "stop" button quickly enough. The judge found that language in the liability release that season passholders sign relieves the mountain from liability in cases of lift attendant negligence, and only allows for mechanical breakdown.
