If things go as planned as tonight's city council meeting, the developers of 420 East Hyman in Aspen will have to abide by a "no complaining clause" attached to the land-use ordinance for their top-floor penthouse. The penthouse will be built on top of the Escobar nightclub, and the city wants to avoid the noise complaint filings from penthouse owners that have afflicted restaurants and bars like the Aspen Brewing Company.
