Originally scheduled to open in January 2014, the Aspen restaurant of celebrity chef David Burke is once again embroiled in a lawsuit. The 21,452-sqaure-foot building has been under construction since fall 2013 at the corner of Hopkins Avenue and Galena Street. Work stopped on the building when a general contractor claimed he was not paid for his work, and now a well-known Aspen developer, Mark Hunt, has filed an eviction lawsuit. The latest lawsuit claims a company known as David Burke's Rocky Aspen, LLC, and Patrick McGarth, an executive chef from New York, have broken leases for two spaces in the building. The lawsuit also claims that Hunt is owed over $150,000 in rent. Despite the legal woes, David Burke said through his PR firm that they are still hoping to open David Burke Kitchen and a downstairs lounge called Huckleberry Hall this winter.
