Are In-Bounds Avalanches an Inherent Risk of Skiing?

If someone is injured or dies in an avalanche within the boundaries of a ski area, is the operator liable? That question, being heard by the Colorado Supreme Court right now, hinges on whether or not, legally, avalanches are an inherent risk of skiing or only the snow conditions that can cause avalanches. The wrongful death suit has the potential to drastically alter the current interpretation of the Colorado Ski Safety Act, which was enacted to allow ski areas to operate with crippling insurance premiums.
