The latest volley in the ongoing saga of Alta vs. Snowboarders has been tossed into federal appeals court in the form of a snowboarder rebuttal. When we last caught up with the issue, the snowboarders were trying to get the case reinstated after a judge dismissed it last year. Attorneys for Alta argued that, failing to find a Right to Snowboard in the Constitution, the resort is free to make a business decision like banning snowboarders. Not so fast, the boarders' lawyers counter: The boarders aren't looking for a constitutional right to snowboard, just to be treated the same on public land that's already designated "for skiing and other snow sports."
